Linked Properties provides AI-powered property management services in Albania, including but not limited to:

• Multi-channel listing management on platforms like Airbnb and Booking.com
• Professional photography services (interior, drone, 360°)
• Intelligent pricing and revenue optimization
• Digital guest experience and support (AI chatbots, instant responses)
• Property maintenance coordination and cleaning services
• 24/7 customer support and property monitoring
• Performance reporting and analytics

3. Service Packages and Pricing

We offer various service packages with different commission rates and features. Specific pricing, commission structures, and service inclusions are outlined in individual service agreements. By engaging our services, you agree to:

• Pay the agreed commission rate on booking revenue
• Provide accurate property and financial information
• Allow us to manage your property listings and guest communications
• Cover any applicable third-party fees (platform fees, payment processing fees)

4. Property Owner Responsibilities

As a property owner using our services, you agree to:

• Provide accurate and complete property information
• Maintain your property in good condition and comply with all local laws and regulations
• Ensure your property meets safety and health standards
• Grant us necessary access to your property for management purposes
• Maintain adequate property insurance
• Respond promptly to our requests for information or action
• Not interfere with our management of bookings and guest communications

5. Our Responsibilities

Linked Properties commits to:

• Manage your property professionally and in accordance with industry standards
• Optimize your listings for maximum visibility and bookings
• Handle guest communications promptly and professionally
• Provide regular performance reports and financial statements
• Coordinate cleaning and maintenance services
• Implement dynamic pricing strategies to maximize revenue
• Provide 24/7 support for guest and property issues

6. Payment Terms

Payment and financial arrangements include:

• Commission is calculated as a percentage of booking revenue as specified in your service agreement
• Additional services (photography, onboarding, premium features) may incur separate fees
• Payouts to property owners are processed monthly, minus our commission and any agreed expenses
• All prices are in the currency specified in your service agreement
• Late payment may result in service suspension or termination

7. Service Agreement Duration and Termination

Service agreements typically have a minimum term as specified in your contract. Either party may terminate the agreement by providing written notice as outlined in the service agreement. Upon termination:

• You remain responsible for any bookings made during the agreement period
• We will transfer control of listings and accounts as appropriate
• Final financial settlement will be processed within 30 days
• We may retain certain data as required by law or for legitimate business purposes

8. Intellectual Property

All content created by Linked Properties, including but not limited to listing descriptions, marketing materials, photography (when provided by us), and website designs, remains our intellectual property unless otherwise agreed in writing.

You grant us a non-exclusive license to use your property information, images, and branding for the purpose of marketing and managing your property.

9. Limitation of Liability

To the maximum extent permitted by law, Linked Properties shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities
• Damage to property or injury to persons caused by guests
• Actions or inactions of third-party platforms (Airbnb, Booking.com, etc.)
• Losses due to events beyond our reasonable control (force majeure)
• Guest cancellations, refunds, or disputes handled by booking platforms

Our total liability for any claim shall not exceed the total commissions paid to us by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Linked Properties, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms, (b) your violation of any law or regulation, (c) your property or its condition, (d) guest injuries or property damage, or (e) your breach of any third-party rights.

11. Third-Party Platforms

We manage your listings on third-party platforms such as Airbnb and Booking.com. Your relationship with these platforms is governed by their respective terms of service. We are not responsible for changes to their policies, fees, or service disruptions. You acknowledge that these platforms may charge their own fees separate from our commission.

12. Data Protection and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to such processing and warrant that all data provided by you is accurate.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Albania. Any disputes arising from these Terms or our services shall be resolved through:

• Good faith negotiation between the parties
• If negotiation fails, mediation in Albania
• If mediation fails, arbitration or litigation in Albanian courts

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with any individual service agreement and our Privacy Policy, constitute the entire agreement between you and Linked Properties regarding our services.
